Terms and conditions

“Alexey Kulikov Photography” is operated by Alexey Kulikov (“us,” “we,” or “our”). “The Client” (”you”, “your”), is any person, group of people, firm, or company who enters and uses the santophoto.com website and any of its products or services (collectively, “Website” or “Services”).

This Agreement sets forth the general terms and conditions of your use of the Website and any of its products or services. By using the Website or its Services, you are consenting to adhere to this Agreement. If you do not consent to comply with the terms outlined in this Agreement, you are not permitted to utilize or access the Website and its Services.

Copyrights

The intellectual property rights and copyright of all images produced will remain with Alexey Kulikov. These photographs are protected by Copyright Law and cannot be reproduced in any form without explicit written permission from Alexey Kulikov Photography. In the event that the Client has acquired a “digital download / Image USB” from Alexey Kulikov Photography, a Personal Usage, Non-Exclusive License is granted as outlined in the signed contract. This license permits the Client to share the images on social networking platforms and vendor websites, provided the images remain unaltered and proper credit is is explicitly given to Alexey Kulikov Photography. Any publication requires prior written consent from Alexey Kulikov Photography, and the Client is prohibited from reselling the images. Alexey Kulikov Photography retains the right to use any image for advertising purposes without compensation. The Client acknowledges that copyright infringement is unlawful and may result in legal consequences.

Booking Confirmation and Payment

A non-refundable booking fee of 40% and a signed contract are necessary to confirm the dates and times for booking Alexey Kulikov Photography’s services. This fee ensures that Alexey Kulikov Photography’s services are reserved exclusively for the Client’s event on the specified date, preventing the photographers from booking other clients and incurring economic losses. Bookings are confirmed on a first-come, first-served basis, and dates are ONLY secured upon receipt of both the non-refundable booking fee and completed contract.

Payment Schedule

The remaining balance can be paid in full on the event day or at any time before the event, as preferred by the client. If the client fails to make payment as specified, Alexey Kulikov Photography reserves the right to terminate the agreement immediately, retain any payments already made, and not attend the event. The Client will be responsible for any bank charges incurred. Extra services, including orders with third-party suppliers, will only be processed upon receipt of full payment. Post-production work will commence only after full payment has been received, and images will not be released until the final balance is settled in full.

Prices and VAT

As a registered company conducting business in Greece, Alexey Kulikov Photography is committed to full compliance with the country’s taxation regulations. Our VAT registration mandates the imposition of a 24% Value Added Tax (VAT) on the services we provide. The prices showcased on our website do not incorporate VAT. Therefore, a VAT rate of 24% will be added to the total amount due from the client, and this will be clearly itemized on the invoice to ensure transparency and clarity in financial transactions.

Cancelation

Once a booking fee is paid, it is NON-REFUNDABLE due to the reservation of the photography date. Any alternative arrangements shall be subject to discussion between the Client and the Alexey Kulikov Photography. All arrangements will be put in writing. Cancellation must be in writing even if a phone call was made to inform the Photographer of the cancellation. The booking fee will be transferable up to 365 days after cancellation. The Client agrees not to expect a new date to automatically be available. The Client will have the opportunity to reschedule but cannot be prioritized over other previously reserved clients.

Refunds

In the event of cancellation by Alexey Kulikov Photography or due to unforeseen circumstances such as fire, casualty, strike, or other civil disturbances—including but not limited to road closures, severe traffic, terrorism, or causes beyond the control of the parties—or due to the Photographer’s illness, any payments made by the Client will be refunded, and the Photographer shall bear no further liability.

Receiving Images

Images will be ready to deliver 10-12 (ten to twelve) weeks following the event. Delivery will be facilitated through an online sharing service and gallery. Alexey Kulikov Photography is NOT obligated to deliver all the footage captured and RAW files will NOT be provided. Upon taking possession of the finished product, the Client must inform the Alexey Kulikov Photographer of any technical or other problems with the images within 14 days. After 14 days, if no notification has been received, the Client will be deemed to be satisfied with the product.

Purchases

If you are planning to buy any product or service offered through the Website, you may be required to provide specific details relevant to your Purchase, such as your credit card information, card expiry date, and billing address. You confirm and warrant that:

• you have the legal authority to use any credit card(s) or alternative payment method(s) for your Purchase;
• the information you provide is accurate, truthful, and comprehensive.

To facilitate payment and complete Purchases, Alexey Kulikov Photography may utilize third-party services. By providing your information, you grant us authorization to share it with these third parties, in compliance with our Privacy Policy.

We reserve the right to refuse or cancel your order at any time due to factors including product or service availability, inaccuracies in product or service descriptions or pricing, errors in your order, or other valid reasons.

Furthermore, we reserve the right to reject or nullify your order if we suspect fraudulent or unauthorized transactions.

Shop Refunds

All sales of digital images purchased on our website are final. Due to the nature of digital products, we do not offer refunds, returns, or exchanges. Once a purchase is completed, it cannot be undone or refunded under any circumstances. We encourage you to carefully review your order before finalizing your purchase. If you have any questions or concerns about our products, please contact us prior to making a purchase.

Piracy & Sharing

Sharing any product from Alexey Kulikov Photography is strictly prohibited and constitutes piracy. Alexey Kulikov Photography reserves the right to suspend or terminate any account found engaging in such activity and may pursue legal action and seek damages to the maximum extent permitted by law.

Governing Law

These Terms and Conditions are subject to Greek Law and shall be interpreted accordingly. You agree to the exclusive jurisdiction of the courts in Greece, and this submission is irrevocable.

Liability

Under no circumstances shall Alexey Kulikov Photography and its associated parties (such as directors, employees, and partners), be held responsible for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, losses such as profits, data, use, goodwill, or other intangible losses. These damages might arise from

• your ability or inability to access or use the Service;
• any actions or content of third parties on the Service;
• any content acquired from the Service;
• unauthorized access, use, or modification of your transmissions or content.

This applies regardless of the legal theory (warranty, contract, tort, including negligence) and regardless of whether we were aware of the potential for such damages. This applies even if the solutions provided fail to fulfill their essential purpose.

Changes and amendments

We retain the right to amend these Terms and Conditions or our policies concerning the Website or its Services at any time. Any modifications will be effective upon the posting of an updated version of this Agreement on the Website. We will indicate the revised date at the bottom of this page when changes occur. Your continued use of the Website following any such modifications signifies your acceptance of the changes.
